Terms of Service

KAI by KAUFAST — Last updated: April 2026

Summary: KAI is self-hosted software. You own your data. You control your deployment. We provide the software and optional managed services. These terms govern that relationship.

1. Definitions

"KAI" refers to the KAI software application, including the server, client, native apps, and all associated code.

"KAUFAST" refers to KAUFAST, the company that develops KAI, registered in Barcelona, Spain.

"You" or "User" refers to the individual or entity accessing or using KAI.

"Service" refers to the KAI software and any optional managed hosting provided by KAUFAST.

2. Acceptance of Terms

By accessing or using KAI, you agree to be bound by these Terms of Service. If you do not agree, do not use KAI.

3. Service Description

KAI is a self-hosted AI assistant with integrated productivity tools. KAI is designed to run on infrastructure you own or control. KAUFAST does not host your data unless you purchase a managed hosting plan.

4. Access and Accounts

KAI is currently available by invitation only. Access is granted at KAUFAST's discretion. You are responsible for maintaining the security of your login credentials, PIN, and any authentication tokens.

5. Data Ownership

You own all data you create, store, or process through KAI. KAUFAST claims no ownership or licence over your data. For self-hosted deployments, your data never reaches KAUFAST infrastructure.

For managed hosting, KAUFAST acts as a data processor under GDPR. A Data Processing Agreement (DPA) is available upon request.

6. Third-Party AI Providers

KAI routes queries to AI providers (Groq, Mistral, Ollama) based on your configuration and the privacy routing system. When using cloud providers:

8. Intellectual Property

KAI software, including its code, design, documentation, and branding, is the intellectual property of KAUFAST. Your licence to use KAI is non-exclusive and non-transferable, subject to the plan you have purchased or been granted.

9. Availability and Support

For self-hosted deployments, uptime depends on your infrastructure. KAUFAST does not guarantee availability for self-hosted instances.

For managed hosting, KAUFAST targets 99.5% uptime but does not guarantee uninterrupted service. Planned maintenance will be communicated in advance where possible.

10. Limitation of Liability

KAI is provided "as is" without warranties of any kind, express or implied. KAUFAST is not liable for:

To the maximum extent permitted by law, KAUFAST's total liability for any claim arising from the use of KAI shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or EUR 100, whichever is greater.

11. Termination

You may stop using KAI at any time. For self-hosted deployments, simply stop running the software. For managed hosting, contact us to cancel and we will delete your instance within 30 days.

KAUFAST may terminate or suspend your access if you violate these Terms, with reasonable notice where possible.

12. Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Barcelona, Spain. If you are a consumer in the EU, you retain any mandatory consumer protection rights under the laws of your country of residence.

13. Changes to These Terms

KAUFAST may update these Terms as the Service evolves. Material changes will be communicated via the app or email. Continued use of KAI after changes constitutes acceptance of the updated Terms.
